The catch worth understanding
The settlement pays documented losses first, and the site says plainly that if those claims swallow the whole net fund, the no-proof payments drop to zero. Nobody publishes an estimate for the no-proof share. The monitoring, though, is untouched by that math — which makes it the one benefit every class member should grab regardless of which cash lane they pick.
What happened
The breach happened on or about May 31, 2024, at FinWise Bank in Utah, and the affected files held names, dates of birth, Social Security numbers, and customer account numbers. The case is Minter v. FinWise Bank et al., No. 2:25-cv-00569-JNP-CMR, before Judge Jill N. Parish in the District of Utah — and FinWise Bancorp and American First Finance are named as co-defendants, which is why AFF customers received notices too.
Who qualifies
Per the official settlement site, the class is all living, natural persons in the United States whose private information was affected by the incident — including everyone who was sent a breach notice. The notice is the practical marker: if one arrived addressed to you, you're in.
What you can claim
- Documented losses — up to $5,000. For actual, unreimbursed costs fairly traceable to the incident, with reasonable documentation attached.
- Cash fund payment — no proof. An equal pro rata share of the net fund. No estimate is published, and it exists only if documented claims leave money behind.
- Credit monitoring — two years, three bureaus. Claimed on the same form, in addition to either cash option, and immune to the fund math above.
