Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Class Action Buddy ("CAB", "the App", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

CAB is a mobile application that helps users discover and file claims for class action settlements. We provide:

  • Information about available class action settlements
  • Tools to help prepare and submit claim forms
  • Tracking of your submitted claims

IMPORTANT: CAB is NOT a law firm and does not provide legal advice. We are a technology service that assists with administrative tasks related to filing settlement claims.

3. Authorization to Submit Claims

By using our service to submit claims, you authorize CAB to:

  • Prepare claim forms on your behalf using information you provide
  • Submit these forms to settlement administrators
  • Receive correspondence related to your claims

You represent that:

  • All information you provide is accurate and truthful
  • You are eligible for the settlements you claim
  • You have the legal right to file these claims

4. Truthfulness of Claims & Penalty of Perjury

⚠️ IMPORTANT LEGAL NOTICE

Class action settlement claim forms are legal documents. When you submit a claim through CAB, you acknowledge and agree that:

  • Many claim forms require submission under penalty of perjury
  • You are certifying that all information provided is true and accurate
  • Submitting false or fraudulent claims is illegal and may constitute:
    • Perjury
    • Fraud
    • Theft
    • Other criminal offenses
  • False claims may result in civil and criminal penalties

Your Certification

By submitting any claim through CAB, you certify that:

  1. You personally meet the eligibility requirements for the settlement
  2. All information you provide is truthful and accurate to the best of your knowledge
  3. You have not already submitted a claim for the same settlement
  4. You understand that false claims are punishable by law

5. Fraud Prevention & Cooperation with Authorities

To protect the integrity of the class action settlement process, CAB:

  • Maintains records of all claim submissions for verification purposes
  • Cooperates fully with settlement administrators, courts, and law enforcement
  • May report suspected fraudulent activity to appropriate authorities
  • May share information with settlement administrators for claim verification
  • Reserves the right to suspend or terminate accounts suspected of fraud

Investigation Rights

We reserve the right to investigate any suspected fraudulent activity and may:

  • Suspend your account pending investigation
  • Report findings to settlement administrators and courts
  • Provide records to law enforcement upon lawful request
  • Cooperate with any legal proceedings related to fraudulent claims

6. Data Retention for Legal Compliance

You acknowledge and agree that CAB will retain certain data as required by law and for fraud prevention:

This retention is necessary to:

  • Respond to settlement administrator audits and inquiries
  • Comply with court orders and legal process
  • Defend against allegations of facilitating fraud
  • Cooperate with law enforcement investigations
  • Protect CAB and legitimate users from liability

7. User Accounts

You must create an account to use CAB. You are responsible for:

  • Maintaining the security of your account
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use

We may suspend or terminate accounts that violate these terms or are suspected of fraudulent activity.

8. Subscription & Payments

CAB offers both free and premium subscription tiers:

Subscriptions automatically renew unless cancelled. You may cancel at any time through your device's app store settings.

9. No Guarantee of Payment

IMPORTANT: We do NOT guarantee that you will receive any payment from class action settlements. Settlement administrators make all decisions regarding:

  • Claim eligibility
  • Payment amounts
  • Payment timing

CAB has no control over these decisions. Historical payout amounts shown in the App are estimates only.

10. Prohibited Conduct

You agree NOT to:

  • Submit false, fraudulent, or misleading claims
  • Claim settlements you are not eligible for
  • Create multiple accounts to circumvent limits
  • Submit duplicate claims for the same settlement
  • Use the service for any illegal purpose
  • Impersonate another person
  • Interfere with the operation of the service
  • Attempt to circumvent fraud detection measures

Violation of these terms may result in immediate account termination and referral to appropriate authorities.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • CAB is provided "as is" without warranties
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid for the service
  • We are not responsible for settlement administrator decisions
  • We are not liable for consequences of fraudulent claims you submit

12. Indemnification

You agree to indemnify and hold harmless CAB, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your submission of false or fraudulent claims
  • Your violation of any law or rights of a third party
  • Any claims made by settlement administrators regarding your submissions

13. Intellectual Property

All content, features, and functionality of CAB are owned by us and protected by copyright, trademark, and other intellectual property laws.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States. Any disputes will be resolved through binding arbitration, except where prohibited by law.

15. Changes to Terms

We may update these terms at any time. Continued use of the App after changes constitutes acceptance of new terms. We will notify you of material changes via email or in-app notification.
