Your Right to Delete Your Data

At Class Action Buddy, we respect your privacy and your right to control your personal data. You have the right to request deletion of your personal information in accordance with GDPR, CCPA, and other applicable privacy regulations, subject to certain exceptions outlined below.


What Data We Store

When you use Class Action Buddy, we may store the following information:

  • Account Information: Name, email address, phone number
  • Profile Data: Mailing address, payment preferences (Venmo/Zelle username)
  • Claim History: Records of settlements you've claimed through our service
  • Claim Submissions: Copies of forms submitted to settlement administrators
  • Usage Data: App usage patterns, device information, timestamps

How to Request Data Deletion

Option 1: Email Request (Recommended)

Send an email to:

Please include in your email:

  • Subject line: "Data Deletion Request"
  • The email address associated with your account
  • Your full name as it appears in your account
  • Confirmation that you want ALL your data deleted

Option 2: In-App Request

If you still have access to the app:

  1. Open Class Action Buddy
  2. Go to Settings β†’ Account
  3. Tap "Delete My Account"
  4. Confirm your decision

Data Deletion Timeline

Timeline Action
Within 48 hours We acknowledge your request via email
Within 7 days Your account is deactivated; we review your account for any legal holds or exceptions (see below)
Within 30 days Eligible personal data is permanently deleted from active systems
Within 90 days Data removed from backup systems (unless subject to legal retention)

βš–οΈ Legal Exceptions to Data Deletion

Under GDPR Article 17(3), CCPA, and other data protection laws, we are permitted and may be required to retain your data in the following circumstances:

1. Compliance with Legal Obligations

We may retain data necessary to comply with legal obligations, including:

  • Tax and financial record-keeping requirements (typically 7 years)
  • Court orders, subpoenas, or legal process
  • Regulatory requirements

2. Establishment, Exercise, or Defense of Legal Claims

We may retain data when necessary for:

  • Pending or anticipated litigation
  • Responding to legal claims or disputes
  • Cooperating with law enforcement or regulatory investigations
  • Settlement claim verification and audit purposes

3. Fraud Prevention and Detection

⚠️ Important Notice: Class action settlement claims are legal documents submitted under penalty of perjury. We are required to maintain records of all claim submissions for fraud prevention purposes and to comply with settlement administrator and court requirements.

We may retain data to:

  • Prevent fraudulent account recreation
  • Assist settlement administrators with claim verification
  • Respond to inquiries from courts or settlement administrators
  • Protect the integrity of the settlement process
  • Comply with our obligations to settlement administrators and courts

4. Legal Hold

If your account is subject to a legal hold due to:

  • Suspected fraudulent activity
  • Active investigation by settlement administrators
  • Pending legal proceedings
  • Law enforcement request

Your data deletion request will be paused until the legal matter is resolved. We will notify you if your request is subject to a legal hold (unless prohibited by law from doing so).


Claim Records Retention

ℹ️ Settlement Claim Data: Because class action claims are legal documents, we retain records of all claim submissions for a minimum of 7 years after the settlement closes, or longer if required by law or ongoing legal proceedings. This is necessary to:

  • Respond to settlement administrator audits
  • Comply with court requirements
  • Protect against fraud allegations
  • Defend against potential legal claims

This retention is permitted under GDPR Article 17(3)(e) and similar provisions in other privacy laws.

Consequences of Account Deletion

Please note that deleting your account will:

  • ❌ Permanently delete your account and login access
  • ❌ Cancel any active subscriptions
  • ❌ Remove you from receiving new settlement notifications
  • ❌ Be irreversible - you cannot recover your account

Account deletion will NOT:

  • Delete claim records already submitted to settlement administrators
  • Remove records we are legally required to retain
  • Affect claims already in progress with settlement administrators

Third-Party Data

When you submit claims through our service, your information is shared with settlement administrators. We cannot delete data held by third parties. You may need to contact settlement administrators directly regarding data they hold.


Verification

To protect your privacy and prevent unauthorized deletion, we may need to verify your identity before processing a deletion request.
