Who Is Eligible?

You may be eligible to file a claim if you:

• The right pork. Raw pork bacon, or fresh and frozen products made from bellies, loins, shoulder, ribs or pork chops, processed by the defendants or their alleged co-conspirators.
• Excluded outright: pork marketed as organic; pork marketed as no-antibiotics-ever (NAE); and any product other than bacon that was marinated, seasoned, flavoured or breaded. These exclusions are written into the claim form and are the most common reason a pork claim does not qualify.
• Bought between 28 June 2014 and 30 June 2018.
• Bought in one of 24 covered states: Arizona, California, District of Columbia, Florida, Hawaii, Illinois, Iowa, Kansas, Maine, Michigan, Minnesota, Missouri, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Rhode Island, South Carolina, Tennessee, Utah and West Virginia. This is where the purchase happened, not where you live now — and the list is not the same as the sibling beef settlement's 27 states.
• Bought for use, not for resale. Individuals qualify for household purchases. A business can also claim where the pork was used by the business or its staff; what is excluded is buying to resell or distribute.
• Employees of the defendants are excluded.
• No receipts and no notice ID are required.

How Much Can You Get?

The administrator has not published a per-person figure and says the amount is not yet known. Payment is pro rata: the fund is divided in proportion to what each claimant estimates they spent, so your share moves with your own number and with how many people file.

What follows is arithmetic you can check, not a promise. The fund is $117,065,000. Take roughly a third for fees and administration and about $78 million is left to distribute. Spread across one to three million claimants, that lands somewhere between $26 and $78 each. Our app shows $40 as the middle of that band, labelled an estimate everywhere it appears.

An order of magnitude, then. Not a quote.

There is no per-claimant cap, so a household that bought a great deal of pork across those four years can land above the range. A light buyer will land below it.

One more thing follows from there being no receipts: your estimate is the entire basis of the claim. The administrator can come back and ask for supporting detail. An inflated number is what gets a claim rejected, so put down what you could stand behind if someone asked.

How to File Your Claim

File with the administrator:

• Work out two numbers for a typical month between June 2014 and June 2018: roughly how many pounds of eligible pork you bought, and roughly what you spent. The form asks for both. If you did not buy every month, it asks instead how many months you did.
• Check your pork against the exclusions above before you estimate. Organic and no-antibiotics-ever purchases do not count towards the total, and neither does seasoned or breaded product unless it is bacon.
• Confirm the purchases happened in one of the 24 covered states.
• Choose how you want to be paid. The form offers a digital Mastercard, a Safeway, Amazon, Kroger or Starbucks card, Instacart credit, Zelle, or a mailed paper cheque. Zelle is the only option that can go to a phone number; the rest need an email address.
