Every Starbucks case, and who it covers
1. The $38.9M New York City settlement — the one that pays
On 1 December 2025 New York City announced a $38.9 million settlement with Starbucks — the largest worker-protection settlement in the city’s history. The Department of Consumer and Worker Protection found Starbucks committed more than 500,000 violations of the city’s Fair Workweek Law since 2021 across more than 300 locations: arbitrarily cutting hours, keeping staff involuntarily part-time while hiring new people, and failing to give predictable schedules (City of New York).
What it pays. Over $35.5 million in restitution to more than 15,000 workers, plus $3.4 million in penalties and costs. Most people who worked an hourly job at a New York City Starbucks receive $50 for each week worked between 4 July 2021 and 7 July 2024. The city’s own worked example: someone employed continuously for a year and a half — 78 weeks — receives $3,900.
You do not file a claim. Eligible employees are paid by check. If you think you were missed, or you were denied reinstatement, you can complain to DCWP online or by calling 311. This is the single most valuable thing on this page — and note carefully who it covers: New York City hourly workers, not customers anywhere.
2. The consumer cases — filed, none paying out
Several consumer class actions have been filed against Starbucks, and none has produced an open settlement or a claim form. The three people search for most:
- Refreshers “missing fruit.” Kominis v. Starbucks, No. 1:22-cv-06673 (S.D.N.Y.), alleged the Mango Dragonfruit, Strawberry Açaí and Pineapple Passionfruit Refreshers contain none of the fruit they are named after. A judge let most of the claims proceed in 2023 — but the parties voluntarily dismissed the case in September 2024, with no public payout and no class claim to file (court docket).
- The decaf “chemicals” case — what “Starbucks cancer warning” searches are about. Williams v. Starbucks, No. 2:26-cv-00112 (W.D. Wash.), filed in January 2026, alleges Starbucks decaf coffee contains traces of methylene chloride, benzene and toluene. It is newly filed and unproven, with no settlement (court docket). The separate California Prop 65 fight over coffee and acrylamide ended in 2022, when the courts confirmed no cancer warning is required for coffee.
- Everything else tracked on ClassAction.org’s Starbucks wire — underfilled cold-brew bottles, the non-dairy-milk surcharge, and coffee sourced from Brazilian supply chains linked to forced labour. None has been certified into a paying class.
These are allegations. None has been proven, none has been certified into a paying class, and there is nothing for a customer to file. If you have seen a site offering a Starbucks consumer claim form — or one inviting you to “sign up” to join the Starbucks lawsuit — it is not real.
