Benworth Capital Partners Data Breach Settlement
By the Class Action Buddy Editorial Team · Last reviewed November 3, 2026
Benworth Capital Partners had a data incident on or about May 18, 2025. Unauthorized access reached names, addresses, Social Security numbers, telephone numbers and loan account information.
That last category is what separates this from a routine breach. Benworth is a lender, so the files held details of people's borrowing rather than just their identity. Loan account information alongside a Social Security number is a useful combination to anyone trying to impersonate a borrower.
The class is living individuals in the United States who were sent notice by Benworth. The notice is the test, as usual.
There is one detail here that catches people out, and it works in your favor. Credit monitoring does not require a claim form. If you are in the class you can take it without filing anything at all. The cash payments do need a claim: a flat payment, or reimbursement of documented losses up to $5,000 if you can evidence them.
So even someone who decides the cash is not worth the paperwork should know the monitoring is sitting there regardless.
The dates run in the usual order but with a real gap. Opting out closes December 4, 2026. Claims run to December 21, 2026, postmarked. Final approval follows on January 5, 2027 in the Circuit Court for Broward County, Florida.

Who Is Eligible?
You may be eligible to file a claim if you:
- A living individual in the United States who was sent notice by Benworth that their information was involved.
- The incident was on or about May 18, 2025, and reached names, addresses, Social Security numbers, telephone numbers and loan account information.
- Benworth is a lender, so the exposed files held borrowing details rather than just identity data — a more useful combination to anyone impersonating a borrower.
How Much Can You Get?
Credit monitoring does not need a claim form. If you are in the class it is available without filing anything. That is unusual and it is the detail most people miss.
The cash does need a claim. Either a flat payment, or reimbursement of documented losses up to $5,000 where you can evidence them against the incident.
So even if you decide the cash is not worth the paperwork, the monitoring is still yours.

Frequently Asked Questions
What is the deadline to file a claim for the Benworth Capital Partners Data Breach Settlement?
The current deadline to file a claim is Dec 21, 2026. Claims sent by mail must be postmarked by this date, so allow about a week for delivery if you are not filing online.
How do I file a claim for the Benworth Capital Partners Data Breach Settlement?
File directly with the settlement administrator, using the official claim form linked on this page. Class Action Buddy does not support this settlement in the app, so the administrator’s own claim process is the route. You do not need a Claimant ID or PIN to file.
Can I get the credit monitoring without filing a claim?
Yes. The settlement makes credit monitoring available to class members without a claim form. Only the cash payments require one, so there is no reason to go without the monitoring.
Why does loan account information matter?
Benworth is a lender, so the files described borrowing, not just identity. Loan details alongside a Social Security number make it considerably easier for someone to pose as an existing borrower.
