New York’s own consumer protection law
Class actions are almost always federal or multi-state, so living in New York rarely decides whether you can claim from a settlement. Where it can matter is when the claim rests on New York’s own statute.
New York General Business Law § 349 (N.Y. Gen. Bus. Law § 349). This one has recently been widened. It now reads “unfair, deceptive, or abusive acts or practices” — not deceptive alone — and defines unfair on the federal test: an act is unfair when it “causes or is likely to cause substantial injury which is not reasonably avoidable and is not outweighed by countervailing benefits to consumers or to competition.” Conduct that is merely unfair, with nothing untrue said, is now inside the statute.
