Kimco Staffing Services Data Breach Settlement
By the Class Action Buddy Editorial Team · Last reviewed November 3, 2026
The number attached to this settlement is $1,040,000, and most of what you read about it will stop there. Only $640,000 of that is money. The other $400,000 is the value of security upgrades Kimco promised to make to its own systems, which is worth something to the next person it hires and nothing to your bank balance.
Kimco Staffing Services is a temp and placement agency, so the roughly 69,687 people caught in this are mostly job seekers who handed over a Social Security number to get work. The attack happened around June 24, 2023. Names, Social Security numbers, financial account details and payment card numbers were in reach. Notice letters went out near the end of 2023, which was three years ago, so a lot of people have long since filed the envelope somewhere and forgotten the whole thing.
One useful feature here: the benefits stack. You are not picking one.
Claims close December 15, 2026.

Who Is Eligible?
You may be eligible to file a claim if you:
- You live in the United States and Kimco identified you among the approximately 69,687 people caught in the incident, which includes everyone sent a notice letter.
- The attack was on or about June 24, 2023, and reached names, Social Security numbers, financial account information and payment card information.
- Notice letters went out around December 2023. That is why this may not ring a bell. The envelope arrived three years ago.
- Kimco is a staffing agency, so the exposed group is largely people who handed over a Social Security number in order to be placed in a job, not customers who bought anything.
- Excluded: Kimco, entities it controls or is controlled by, its affiliates and legal representatives, the judges and court staff on the case with their immediate families, and anyone who opts out in time.
How Much Can You Get?
The headline is $1,040,000. The money is $640,000. The remaining $400,000 is the stated value of “Business Practice Enhancements” — security work Kimco agreed to do on its own systems. That protects the next person it places. It does not reach your bank account.
The $640,000 is non-reversionary, which means whatever is left after valid claims does not go back to Kimco.
Benefits stack, and this is the part worth reading twice. You are not choosing one:
Credit monitoring and identity protection for two years with $1,000,000 of identity theft insurance, given to anyone who files a valid claim for any benefit at all.
Up to $5,000 for documented out-of-pocket losses and proven actual monetary losses.
$50 under the CCPA if you were a California resident on June 24, 2023.
A pro rata share of whatever remains once fees, service awards, administration, the monitoring and the above claims are paid, split equally among approved claimants.
How to File Your Claim
File with the administrator:
- Claims close Tuesday, December 15, 2026, filed online or postmarked by that date. The administrator’s own summary paragraph says December 16 for mailed forms while its dates table and rights table both say December 15. Work to the 15th.
- File online at kimcodatasettlement.com, or post the form to Kimco Data Incident Litigation, c/o Kroll Settlement Administration LLC, P.O. Box 225391, New York, NY 10150-5391.
- Opting out or objecting closed November 16, 2026, well before the claim deadline, so filing is the remaining option for most people.
- Final approval hearing is Thursday, February 18, 2027 at 2:00 p.m. Pacific. Payment follows approval and any appeals.
- Help: (833) 876-1553 or info@KimcoDataSettlement.com.
- The case is Kimco Staffing Data Breach Cases, Judicial Council Coordination Proceeding No. 5321, before the Hon. Melissa R. McCormick in the Superior Court of California, County of Orange.

Frequently Asked Questions
What is the deadline to file a claim for the Kimco Staffing Services Data Breach Settlement?
The current deadline to file a claim is Dec 15, 2026. Claims sent by mail must be postmarked by this date, so allow about a week for delivery if you are not filing online.
How do I file a claim for the Kimco Staffing Services Data Breach Settlement?
File directly with the settlement administrator, using the official claim form linked on this page. Class Action Buddy does not support this settlement in the app, so the administrator’s own claim process is the route. You do not need a Claimant ID or PIN to file.
Do I have to pick between the $50 and the credit monitoring?
No, and that is unusual. The benefits here stack. A California resident with documented losses can claim the $50 CCPA payment, the out-of-pocket reimbursement, the two years of monitoring and a pro rata share of the residue on a single form. Most breach settlements make you choose.
Is this really a $1 million settlement?
Not in cash. $640,000 is the common fund that pays people. The other $400,000 is the assigned value of security improvements Kimco promised to make internally. Both are real, but only one of them is divisible among 69,687 people.
I worked a temp job through Kimco years ago and never got a letter.
The class is defined as people Kimco identified as impacted, which includes but is not limited to those sent notice. If you think you are in the group and no letter reached you, ring the administrator on (833) 876-1553 before December 15 rather than assuming either way.
