Datadog Commercial Account Executive Overtime Settlement
By the Class Action Buddy Editorial Team · Last reviewed November 3, 2026
If you sold for Datadog as a Commercial Account Executive, this settlement splits your class into two halves that have opposite instructions, and getting the wrong half's advice costs you the whole payment.
Worked in Colorado or Massachusetts? You are already in. Do nothing and a payment comes to you. Worked anywhere else in the country? You are in the FLSA collective instead, and nothing reaches you unless you send back a Consent to Join form. Silence is not neutral there. It is a decision to take nothing.
The case is Gallegos and Santiago v. Datadog, Inc., Index No. 609627/2026, in the Supreme Court of the State of New York, Nassau County. It covers Commercial Account Executives employed between December 1, 2022 and December 1, 2025. The dispute is whether that role was correctly treated as exempt from overtime under federal law and under the wage laws of Colorado and Massachusetts. Datadog denies all of it and says it paid people properly.
November 20, 2026 closes every option at once.

Who Is Eligible?
You may be eligible to file a claim if you:
- You held the Commercial Account Executive role at Datadog at some point between December 1, 2022 and December 1, 2025. No other job title is covered.
- Worked in Colorado or Massachusetts: you are a Class Member. You are already included under CPLR sections 901 and 902 and will be paid without filing anything, unless you exclude yourself.
- Worked in any other state: you are a Collective Member. You are in the FLSA section 216(b) collective, and you are paid only if you return a Consent to Join form. Doing nothing pays nothing.
- Not a consumer settlement. Being a Datadog customer, or having used the product, gives you no claim here. This is an unpaid-overtime case about one sales job.
How Much Can You Get?
$4,150,000 is the ceiling on everything, not a pot divided among claimants alone. Attorneys’ fees of one third of the gross fund come out of it, plus $16,210 of approved costs, the approval-motion filing fees, service awards to the two named plaintiffs and the whole cost of administration.
Your own number is already calculated. The settlement runs off Datadog’s payroll records, so the estimated payment for your employment history is printed on the form sent to you rather than being something you work out or negotiate. There is no documentation to dig up and no receipt to find.
This one is already approved. The Court granted approval on August 18, 2026 and entered the order in September. Unless a Class Member objects and asks to be heard, that order stands as the Final Order, so there is no future fairness hearing standing between a valid claim and payment.
How to File Your Claim
File with the administrator:
- November 20, 2026 is the only date. The consent deadline, the opt-out deadline and the objection deadline all land on it.
- Collective Members file the Consent to Join Settlement, Release, and Claim Form at datadogsettlement.com. Returning it releases your unpaid wage claims against Datadog and is what triggers payment.
- If you do nothing as a Collective Member, you release nothing and receive nothing, and the statute of limitations keeps running against whatever claim you kept.
- Class Members in Colorado or Massachusetts need do nothing to be paid, and release all state, local and federal wage and hour claims in exchange.
- Questions go to CPT Group, the administrator, on 1-888-261-1802 or DatadogSettlement@cptgroup.com. Class counsel is Shavitz Law Group, P.A.
- The case is Gallegos and Santiago v. Datadog, Inc., Index No. 609627/2026, Supreme Court of the State of New York, County of Nassau.

Frequently Asked Questions
What is the deadline to file a claim for the Datadog Commercial Account Executive Overtime Settlement?
The current deadline to file a claim is Nov 20, 2026. Claims sent by mail must be postmarked by this date, so allow about a week for delivery if you are not filing online.
Do I need proof of purchase for the Datadog Commercial Account Executive Overtime Settlement?
No proof of purchase is required — you can typically file based on a sworn statement, without receipts, photos, or product packaging. You also do not need a Claimant ID or PIN to file.
How do I file a claim for the Datadog Commercial Account Executive Overtime Settlement?
File directly with the settlement administrator, using the official claim form linked on this page. Class Action Buddy does not support this settlement in the app, so the administrator’s own claim process is the route. You do not need a Claimant ID or PIN to file.
I was a Commercial Account Executive in Texas. Do I need to do anything?
Yes, and this is the half of the class that loses money by guessing. Every state other than Colorado and Massachusetts falls in the FLSA collective, which works by opting in. If your Consent to Join form is not back by November 20, 2026 you are paid nothing, even though you are plainly within the covered role and dates.
Why do Colorado and Massachusetts get different rules?
Because those two were certified as a state-law class under New York civil procedure rules, which bind everyone in the group unless they actively leave. The federal overtime statute works the opposite way round and only covers people who join in writing. Same lawsuit, same settlement, two legal mechanisms.
How much will I get?
The estimate specific to you is on the form you were sent, because it is derived from Datadog payroll data rather than anything you report. The fund caps at $4,150,000 before one third in attorneys fees, $16,210 in costs, service awards and administration are taken out.
Does Class Action Buddy file this one for me?
No. This is an employment claim tied to your payroll record and the administrator already holds your figures, so there is nothing for an app to fill in. Use the consent form on the official site.
