Who Is Eligible?

You may be eligible to file a claim if you:

• The settlement class, in the court's own words, is all Washington residents who did not sign up for Davison's text messages but were texted by Davison at a Washington-area-code cellular number, after that number was last disconnected and reassigned.
• Every one of those four conditions has to hold. Washington resident. Washington area code. A cell number, not a landline. And the reassignment, which is the condition that rules most people out.
• The signups and the messages must fall between 15 November 2021 and 10 December 2025.
• Reassignment is settled by the Reassigned Number Database, the record of when a number was given up by one subscriber and handed to another. The settlement uses the version last updated on 16 February 2026, so this turns on a record rather than on anyone's memory.
• You may have had a text message or a postcard telling you that you are a class member. That notice is not the only route in. If your number shows up in Davison's records you can still be covered, and the administrator's contact page is where to sort that out.
• Davison is a Pennsylvania company that sells research and development services to people with product ideas, charging between $395 and $16,000. The texts at issue invited recipients to submit an idea. Davison denies liability and says it made a good-faith effort to comply.

How Much Can You Get?

The whole fund is $30,000. That figure is worth repeating because this page previously reported it as $30 million, and the difference changes what filing is worth to you.

Three things come out of it before anyone gets paid. Class Counsel will ask the Court for attorneys' fees equal to 33% of the fund, inclusive of litigation costs, which is close to $9,900. Settlement administration expenses come out next. Whatever remains is divided among the people who file valid claims.

No per-person figure exists yet, and the administrator says so plainly: the amount cannot be worked out until the claim deadline has passed, because it depends on how many valid claims arrive and what deductions the Court approves.

What you can do is the arithmetic on the ceiling. The fee request alone takes about $9,900, leaving roughly $20,100, and administration costs come out of that too. If a few hundred people claim, this is a small payment rather than a windfall, and it is better to know that before you spend twenty minutes on the form than after.

Payment depends on final approval. The Court has set a Final Approval Hearing for 17 November 2026 in Spokane, and nothing is distributed unless the settlement is approved and becomes final. Appeals can push that further out.

How to File Your Claim

File with the administrator:

• Check the four conditions first. Washington resident, Washington area code, a cell number, and the number reassigned to you after someone else gave it up. Fail any one of them and the form is wasted effort.
• File online at millertextsettlement.com, on the Submit a Claim page, or post a paper form to Miller v. Davison Design & Dev., c/o Class Experts Group, LLC, P.O. Box 995, Mequon, WI 53092. Either way it has to be in or postmarked by 13 October 2026.
• Pick one route and stick to it. The administrator asks you not to file both online and on paper, and sending more than one form will not get you more than one payment.
• You do not need receipts, screenshots or any other document. You need your own phone numbers. The form asks for every cellular number you held between 15 November 2021 and 10 December 2025 together with the dates you had each one, and you sign the whole thing under penalty of perjury under 28 U.S.C. section 1746(2). There is a Notice ID box, but it is optional, so not having one does not stop you.
• Two dates have already gone. Exclusion and objection both closed on 13 September 2026. Filing a claim or doing nothing are the choices that remain, and doing nothing releases your claims anyway.
• Tell the administrator if you move. Once your form is in, keeping your address and email current is your responsibility, through the contact page or the PO box above.
• The Final Approval Hearing is on 17 November 2026 before Judge Rebecca L. Pennell at the Thomas S. Foley U.S. Courthouse, 920 West Riverside Avenue, Spokane. You do not have to attend. Class Counsel, The HQ Firm, appears for the class and takes questions on 385-440-4100.
