Kisco Senior Living Data Breach Settlement
By the Class Action Buddy Editorial Team · Last reviewed October 27, 2026
Kisco Senior Living had a data incident over roughly a week, June 1 to June 6, 2023. It began telling affected people about it in April 2024, nearly ten months later. The settlement resolves the case without Kisco conceding anything.
Who is covered is refreshingly simple: every US resident Kisco sent written notice to. No serial numbers, no purchase records, no date ranges to work out. If the letter came, you are in the class.
The fund is $1,800,000, and it stretches across several different benefits. You can claim reimbursement for ordinary out-of-pocket losses, for extraordinary losses, and for time you spent dealing with the fallout. Credit monitoring is available. Whatever remains after those claims, the notice costs, service awards of up to $5,000 per class representative and attorneys' fees of up to $600,000 plus $50,000 in expenses gets divided as a residual cash payment.
There is one benefit that only some people can claim. If you lived in California when the incident happened, you can claim a $250 statutory payment on top — California's privacy statute provides for it, and residents of other states have no equivalent. It is the single largest fixed amount in the settlement and the easiest to overlook.
Claims close January 19, 2027, which leaves an unusually long runway. The case is in the Southern District of California.

Who Is Eligible?
You may be eligible to file a claim if you:
- Any United States resident Kisco sent written notice to about the data incident. That is the whole test — the court defined the class exactly that way.
- The incident ran June 1 to June 6, 2023. Kisco began notifying people in April 2024, around ten months later.
- California residents get an extra benefit. If you lived in California at the time of the incident, you can claim a $250 statutory payment that residents of other states cannot.
How Much Can You Get?
The fund is $1,800,000 and it stretches across several benefits.
$250 for California residents at the time of the incident, under California’s privacy statute. It is the largest fixed amount in the settlement and the easiest one to overlook.
Documented losses are claimable as ordinary out-of-pocket losses, as extraordinary losses for more serious harm, and as attested time spent dealing with the fallout.
Credit monitoring is offered separately.
A residual cash payment comes from what is left after those claims, notice and administration costs, service awards of up to $5,000 per class representative, and attorneys’ fees of up to $600,000 plus $50,000 in expenses.
How to File Your Claim
File with the administrator:
- File by January 19, 2027 at kiscosettlement.com. That is an unusually long runway, so there is no need to rush — but also no reason to forget it.
- If you were in California in June 2023, say so. The $250 statutory payment is claimed on the same form and is worth more than most residual payments.
- Attested time is claimable alongside documented losses, which not every breach settlement allows.
- The case is Gois, et al. v. Kisco Senior Living, LLC, No. 24-cv-751-BJC-AHG, in the United States District Court for the Southern District of California.

Frequently Asked Questions
What is the deadline to file a claim for the Kisco Senior Living Data Breach Settlement?
The current deadline to file a claim is Jan 19, 2027. Claims sent by mail must be postmarked by this date, so allow about a week for delivery if you are not filing online.
How do I file a claim for the Kisco Senior Living Data Breach Settlement?
File directly with the settlement administrator, using the official claim form linked on this page. Class Action Buddy does not support this settlement in the app, so the administrator’s own claim process is the route. You do not need a Claimant ID or PIN to file.
What is the $250 California payment?
California’s privacy statute provides a fixed statutory payment for residents whose information is exposed. If you lived in California at the time of the June 2023 incident you can claim it in addition to any documented losses. Residents of other states have no equivalent.
I have no receipts. Is it worth filing?
Yes. The residual cash payment needs no documentation, and if you were a California resident the $250 statutory payment does not depend on proving a loss either.
Why did notice take ten months?
The incident ran June 1 to 6, 2023, and Kisco began notifying people in April 2024. The settlement does not explain the gap, and the delay is among the things the lawsuit complained about.
