Peco Foods Data Breach Settlement
By the Class Action Buddy Editorial Team · Last reviewed October 27, 2026
Peco Foods was breached around December 4, 2023. An unauthorized third party reached personal information the company held. Notice letters went out about seven months later, around July 24, 2024. Peco denies wrongdoing and has settled without any finding against it.
The class is everyone in the United States whose information was caught in that breach and who received one of those letters. The letter is the practical test, because the settlement is built around the list Peco mailed.
There is an oddity in the calendar that catches people out. The deadline to exclude yourself passed on October 12, 2026. The deadline to file a claim is November 9, 2026 and has not. If you are in the class you are already bound by the outcome whether you file or not, so the only open question is whether you collect anything for it.
The fund is $950,000. Documented losses get reimbursed first, credit monitoring is on offer, and what survives all of that is split as a residual cash payment. The residual is the part most people will actually see, and its size moves with how many claims arrive.
One detail that surprises people: the case sits in the Circuit Court of Tuscaloosa County, Alabama rather than a federal court. That is unusual for a data breach settlement and changes nothing about how you file.

Who Is Eligible?
You may be eligible to file a claim if you:
- A United States resident whose information was taken in the Peco Foods breach of around December 4, 2023.
- You received the notice letter Peco sent around July 24, 2024. The settlement is built around that mailing list.
- Who is excluded: the presiding judge, their staff and immediate family; Peco’s officers, directors, members and shareholders; anyone who opted out; and anyone criminally culpable for the breach.
How Much Can You Get?
The fund is $950,000 and it covers several different claims.
Documented losses come in two tiers — ordinary out-of-pocket losses, and extraordinary ones for larger harm such as identity theft. Both need evidence tying them to the breach.
Credit monitoring is available as a separate benefit.
A residual cash payment is made from whatever remains. For most people this is the part they will actually receive, and its size moves with how many claims come in.
How to File Your Claim
File with the administrator:
- File by November 9, 2026 at pecofoodsdatasettlement.com.
- The opt-out deadline has already gone — it was October 12, 2026. If you are in the class you are bound by the outcome now whether you file or not, so the only question left is whether you collect anything.
- Keep your paperwork if you are claiming out-of-pocket losses; the residual cash payment does not need it.
- The case is Ryan, et al. v. Peco Foods Inc., Case No. 63-CV-2025-900067, in the Circuit Court of Tuscaloosa County, Alabama — a state court rather than a federal one, which is unusual for a data breach settlement and changes nothing about filing.

Frequently Asked Questions
What is the deadline to file a claim for the Peco Foods Data Breach Settlement?
The current deadline to file a claim is Nov 09, 2026. Claims sent by mail must be postmarked by this date, so allow about a week for delivery if you are not filing online.
How do I file a claim for the Peco Foods Data Breach Settlement?
File directly with the settlement administrator, using the official claim form linked on this page. Class Action Buddy does not support this settlement in the app, so the administrator’s own claim process is the route. You do not need a Claimant ID or PIN to file.
I missed the opt-out date. What does that mean?
It means you are part of the settlement and bound by its release whether or not you file. Since you cannot leave, the only remaining decision is whether to claim your share before November 9, 2026.
How much is the residual cash payment?
It is not fixed. It is whatever remains of the $950,000 after documented-loss claims, credit monitoring, notice costs, fees and service awards, divided among valid claims. Turnout sets the figure.
Why is this in an Alabama state court?
Peco Foods is headquartered in Tuscaloosa, and the case was filed in the Circuit Court of Tuscaloosa County rather than federal court. It makes no practical difference to how you file or what you can claim.
