Who Is Eligible?

You may be eligible to file a claim if you:

• The class is everyone in the United States who was sent notice of the incident and appears on the class list the court approved. That is the whole definition. Recognizing the company name is not part of it.
• There is no class period, whatever you may have read here before. This is one event, on or about 12 November 2025, not a window of time you have to fall inside.
• What was taken varied person to person. The notice lists names, dates of birth, Social Security or taxpayer ID numbers, driver's license numbers, state or other government identifiers, financial account numbers, medical records, and health insurance policy numbers. Your letter is the only thing that tells you which of those applied to you.
• Medical records and health insurance numbers are the unusual part. If those were in your file, watch for claims billed in your name as well as for new credit accounts, because the two kinds of fraud show up in completely different places.
• Every class member has already been sent a credit monitoring code for one year of cover. Nobody had to apply for it, which means it is easy to have binned the envelope without realizing what was in it.
• Californians get an extra tier. If you lived in California at any point between 12 and 22 November 2025, you can claim a further $50 on top of everything else.
• Excluded: SitusAMC's executive leadership team, the judge assigned to the case along with their immediate family and court staff, and anyone who opts out by 22 October 2026.
• Not sure whether you are in? The administrator will tell you, and it can also issue the Login ID and PIN you need if the postcard never reached you or went in the recycling.

How Much Can You Get?

SitusAMC is putting $5.3 million into a settlement fund. That is the total, not a per-person figure, and it is spent in a fixed order: attorneys' fees and costs first, then service awards, then administration, and only then class member benefits.

What comes off the top. Class counsel will ask for up to one third of the fund, which is roughly $1.77 million, plus reasonable costs. Each of the six class representatives is asking for a $2,500 service award. Administration costs come out of the same pot.

Credit monitoring, already sent, no claim needed. Every class member automatically received an enrollment code for a year of cover: real-time monitoring of your credit file at a bureau, dark web scanning with immediate alerts, public record monitoring, identity restoration help, and $1,000,000 of identity theft insurance with no deductible.

Cash Payment A pays documented losses up to $5,000. This covers unreimbursed charges from your bank or card issuer, the cost of replacing a driver's license or Social Security number, credit reports, and credit monitoring or identity protection you bought yourself after 12 November 2025. For that last one you also have to state in writing that you bought it because of this breach rather than for general peace of mind.

The documentation rule here is stricter than most. You must supply third-party paperwork such as receipts. A list you typed out yourself can support other documents but cannot carry a claim on its own, and a claim resting only on self-prepared material is not valid.

Cash Payment B is a flat payment estimated at $75 and needs no proof whatsoever. The notice says it can be claimed "in lieu of or in addition to" the documented-loss payment, so having receipts is no reason to skip it. Treat $75 as an estimate rather than a promise, because it moves with the number of valid claims and can land either side of the figure.

The California payment is $50 and sits on top of both. It is open to anyone who lived in California between 12 and 22 November 2025. Unlike the flat payment, this one can only be adjusted downward.

Cash goes out by PayPal, Venmo, Zelle or a mailed check, whichever you pick on the form.

How to File Your Claim

You will need the Claim ID and PIN printed on the notice the administrator sent you. This settlement is not open to anyone who simply believes they qualify.

• File at samcdatasettlement.com, which is run by Simpluris and is the only official site for this case. File online or download the form and post it.
• Find your Login ID and PIN first. They are printed on the postcard notice and the form will not go through without them. If that postcard is long gone, ring the administrator on (833) 421-7329 or email info@SAMCDataSettlement.com and they will give you the numbers.
• Claim the flat payment even if you are claiming documented losses. The notice allows the flat cash "in lieu of or in addition to" the documented-loss claim, so there is no reason to pick.
• Tick the California box if it applies. The form has a specific box for having been a California resident between 12 and 22 November 2025, and it is worth another $50.
• For documented losses, attach third-party paperwork. Receipts, bank or card statements, bills from someone other than you. A self-written summary can clarify what you are attaching but will not stand alone, and a claim built only on your own notes fails.
• Choose how you want paying — PayPal, Venmo, Zelle or a check in the post. You sign the form under penalty of perjury.
• Know what you are giving up. Staying in releases more than the obvious target. It covers claims against SitusAMC, and it reaches the clients and customers who supplied the data that was taken. In plain terms, the company you actually dealt with is protected by this release too. Opting out by 22 October 2026 is the only way to keep those rights, and it costs you every benefit above.
• The dates, in order. Opt out or object by 22 October 2026. File your claim by 6 November 2026. The judge decides whether to approve any of it at a hearing on 11 November 2026, five days after claims close, and payment only follows approval and any appeals.
