Around 1.6 million people were told their information was exposed by American Vision Partners. Roughly 258,070 of them can claim money. If you are in the other 1.3 million, the claim form is not for you, and no amount of persistence will change that.

The split is drawn on Social Security numbers. Those whose SSN went out the door landed in the Damages Settlement Class and can file against a $1,750,000 fund. Everyone else sits in the Injunctive Relief Class. Its entire benefit is a promise from the eye care group to spend about $2,787,630 hardening its systems. That promise is contractually enforceable. It is also not payable to you.

The case is Hulewat v. Medical Management Resource Group LLC, No. 2:24-cv-00377-DJH, in the District of Arizona, naming Barnet Dulaney Perkins Eye Center and Southwestern Eye Center alongside it.

Two timing points matter. Claims close November 12, 2026. The window to opt out or object shut back on October 13, so that choice is already behind you. Being bound either way is a straightforward argument for filing rather than sitting it out.

Who Is Eligible?

You may be eligible to file a claim if you:

  • Damages Settlement Class, roughly 258,070 people. United States residents whose Social Security number and other personal information were compromised. This is the only group that can claim money.
  • Injunctive Relief Class, everyone else. All individuals whose personal information American Vision collects or maintains, which is where most of the 1.6 million notified people sit. There is no cash benefit for this class.
  • Three providers are named: Medical Management Resource Group, L.L.C., Barnet Dulaney Perkins Eye Center, PC, and Southwestern Eye Center, Ltd.
  • Excluded: the defendants and their representatives, any judicial officer on the case plus their immediate family and staff, and anyone who validly opted out.

How Much Can You Get?

A $1,750,000 non-reversionary fund, and you pick one option, not both.

A pro rata cash payment. The amount moves up or down with how many valid claims arrive, capped by the fund, so no honest figure can be quoted in advance.

Or reimbursement of documented out-of-pocket losses fairly traceable to the incident, capped at $3,000 per claimant.

What comes off the top first: class counsel is applying for attorneys’ fees of 33.33% plus litigation costs, and service awards of up to $2,500 for each plaintiff, all payable from that fund. Administration comes out of it too. The pro rata pool is what survives, divided by however many people file.

Separately, and not from the fund: the defendants committed to cybersecurity measures valued at about $2,787,630, as contractually enforceable obligations paid entirely by them. That is the whole benefit of the Injunctive Relief Class.

Frequently Asked Questions

What is the deadline to file a claim for the American Vision Partners Data Breach Settlement?

The current deadline to file a claim is Nov 12, 2026. Claims sent by mail must be postmarked by this date, so allow about a week for delivery if you are not filing online.

How do I file a claim for the American Vision Partners Data Breach Settlement?

File directly with the settlement administrator, using the official claim form linked on this page. Class Action Buddy does not support this settlement in the app, so the administrator’s own claim process is the route. You do not need a Claimant ID or PIN to file.

I got a notice letter. Does that mean I can claim cash?

Not on its own. About 1.6 million people were notified and roughly 258,070 are in the Damages Settlement Class, which is drawn around whose Social Security number was compromised. If yours was not, you are in the Injunctive Relief Class and the benefit to you is the security work the providers agreed to, not a payment. Call (833) 630-5366 if your letter does not make clear which you are.

Can I claim the pro rata payment and my documented losses?

No. The settlement is written as one or the other. Compare your documented, traceable losses against an unknown pro rata share, and remember the $3,000 cap applies only to the documented route.

Is it too late because the opt-out date passed?

No. The claim deadline is November 12, 2026 and is separate from the October 13 opt-out date. Missing the opt-out date means you are bound by the settlement either way, which is a reason to file rather than a reason not to.
