What Is the Chantix Settlement?

Pfizer agreed to a $44 million settlement resolving multidistrict litigation over Chantix (varenicline), its prescription smoking-cessation drug. The lawsuits alleged that Chantix was sold while it contained N-nitroso-varenicline — a nitrosamine, a class of compound regulators treat as a probable human carcinogen — and that consumers were not told.

Pfizer recalled batches of Chantix in 2021 and eventually paused distribution. The consolidated case, In re Chantix (Varenicline) Marketing, Sales Practices and Products Liability Litigation, MDL No. 3050, was heard in the Southern District of New York. Pfizer denies wrongdoing, and the settlement resolves the claims without any finding of liability.

Importantly, this is an economic-loss settlement. It is about the money you spent on the drug, not about any health effect. You do not need to have been harmed to file — you only need to have paid for it.

Who Is Eligible?

You can file if:

  • You paid any amount out of pocket for a retail purchase of Chantix
  • The purchase was in the United States or its territories
  • It happened between September 29, 2015 and September 17, 2021
  • You bought it for personal or covered use — not for resale

“Any amount” is doing real work in that sentence. A $30 insurance copay counts. So does a $400 cash price if you were uninsured. Third-party payors such as insurers and health plans can also file, through a separate part of the settlement.

There is no proof of purchase required to submit a claim, and no Notice ID or Claim ID to look up — unusual for a settlement this size. You self-report how many prescriptions you filled and roughly what you paid.

How Much Can You Get?

There is no flat per-person amount. Consumers share in up to 20% of the net settlement fund (after fees, costs, and administration), with the remainder allocated to third-party payors. What you personally receive depends on two things: what you report paying, and how many valid claims come in.

Do I need a receipt or my pharmacy records?

Not to file. You self-report the number of prescriptions and your out-of-pocket total. The administrator can request supporting documentation later, so if you happen to have pharmacy printouts or an explanation of benefits, hold onto them.

I don’t have a Claim ID. Can I still file?

What if insurance paid for most of it?

This settlement covers Chantix. Generic varenicline from other manufacturers is not part of it, though some generics were subject to their own nitrosamine recalls.
