This settlement involves allegations that Anthem Blue Cross improperly denied prescription drug coverage to members of grandfathered health plans — plans that existed before the Affordable Care Act. If your drug claim was denied and you paid out of pocket, you may be eligible for compensation.
A grandfathered health plan is a health insurance plan that was in existence before the Affordable Care Act (ACA) was signed into law on March 23, 2010, and has not made significant changes since then. These plans are not required to comply with all ACA provisions, which is at the center of this dispute.
It is not yet confirmed whether proof of a prescription drug denial is required. However, it's a good idea to gather any documentation you have, such as denial letters from Anthem, pharmacy receipts, or Explanation of Benefits (EOB) statements, in case proof is needed when you file.
