Can I File a Class Action Claim if I Live Outside the US?

If you were a US resident at some point but moved abroad, or if you were affected by a US company's conduct while living outside the US, you may still be able to file a US class action claim. It depends on the specific settlement terms.
When it works
- You were a US resident when the harmful conduct happened, but have since moved.
- You are a foreign citizen who was affected by a US company's conduct (e.g., a US-based data breach that included international customers).
- The settlement class definition explicitly includes international members.
Common complications
- Mailing address. The administrator needs somewhere to send your payment. International checks are slow (2-4 weeks). Some administrators pay via international wire, but often deduct fees.
- Tax withholding. Payments to foreign persons may be subject to US withholding tax. You may need to submit Form W-8BEN.
- Currency. Payments are made in USD. Your bank may charge conversion fees.
Practical tips
- Read the settlement notice carefully for international eligibility language.
- If unclear, email the settlement administrator — they can confirm eligibility.
- Use the address you had when the harmful conduct happened (many settlements just want to know you were in the class, not where you live now).
- Consider using a US mailing service (or a US friend's address) for check delivery.
