North Carolina’s own consumer protection law
Class actions are almost always federal or multi-state, so living in North Carolina rarely decides whether you can claim from a settlement. Where it can matter is when the claim rests on North Carolina’s own statute.
North Carolina Unfair and Deceptive Trade Practices Act (N.C.G.S. § 75-1.1). Unfair methods of competition and unfair or deceptive acts “in or affecting commerce” are unlawful, and commerce means “all business activities, however denominated.” There is one express carve-out worth knowing: professional services rendered by a member of a learned profession are outside the Act.
A Chapter 75 claim is barred unless commenced within four years after the cause of action accrued (N.C.G.S. § 75-16.2).
