Colorado’s own consumer protection law
Class actions are almost always federal or multi-state, so living in Colorado rarely decides whether you can claim from a settlement. Where it can matter is when the claim rests on Colorado’s own statute.
Colorado Consumer Protection Act (C.R.S. § 6-1-105). It lists the deceptive trade practices a business commits “in the course of the person’s business, vocation, or occupation” — passing goods off as another’s, false claims about source, sponsorship, approval or certification, and so on. Colorado attaches a mental state to most of them: the business must have acted “knowingly or recklessly,” a higher bar than the states where an innocent misrepresentation is enough.
All actions under the article must be commenced within three years of the deceptive act or its discovery (C.R.S. § 6-1-115).
