Delaware’s own consumer protection law
Class actions are almost always federal or multi-state, so living in Delaware rarely decides whether you can claim from a settlement. Where it can matter is when the claim rests on Delaware’s own statute.
Delaware Consumer Fraud Act (6 Del. C. § 2513). It reaches “deception, fraud, false pretense, false promise, misrepresentation, unfair practice, or the concealment, suppression, or omission of any material fact” in connection with the “sale, lease, receipt, or advertisement” of merchandise. Two things are worth noticing: leases and mere receipt are covered as well as sales, and the act is unlawful “whether or not any person has in fact been misled.”
