Nebraska’s own consumer protection law
Class actions are almost always federal or multi-state, so living in Nebraska rarely decides whether you can claim from a settlement. Where it can matter is when the claim rests on Nebraska’s own statute.
Nebraska Uniform Deceptive Trade Practices Act (Neb. Rev. Stat. § 59-1602). “Unfair methods of competition and unfair or deceptive acts or practices in the conduct of any trade or commerce shall be unlawful.” A single sentence, with the detail left to the neighbouring sections and to the courts.
A damages claim is barred unless commenced within four years of accrual (Neb. Rev. Stat. § 59-1612).
