Nevada’s own consumer protection law
Class actions are almost always federal or multi-state, so living in Nevada rarely decides whether you can claim from a settlement. Where it can matter is when the claim rests on Nevada’s own statute.
Nevada Deceptive Trade Practices Act (NRS 598.0915). It defines the deceptive trade practices, and the first one listed is squarely aimed at advertising: making “an assertion of scientific, clinical or quantifiable fact in an advertisement which would cause a reasonable person to believe that the assertion is true” without holding the substantiation for it at the time. A numbers claim you cannot back up is itself the violation.
