Hawaii’s own consumer protection law
Class actions are almost always federal or multi-state, so living in Hawaii rarely decides whether you can claim from a settlement. Where it can matter is when the claim rests on Hawaii’s own statute.
Hawaii unfair and deceptive practices statute (Haw. Rev. Stat. § 480-2). “Unfair methods of competition and unfair or deceptive acts or practices in the conduct of any trade or commerce are unlawful.” In construing it, both the courts and the state Office of Consumer Protection must give due consideration to the rules, regulations and decisions of the Federal Trade Commission — so the enforcing agency is held to the same federal yardstick as the judges.
An action is barred unless commenced within four years after the cause of action accrues; a continuing violation accrues throughout the violation (HRS § 480-24).
