Maryland’s own consumer protection law

Maryland Consumer Protection Act (Md. Com. Law § 13-301). Maryland covers “unfair, abusive, or deceptive trade practices” — three categories, not two — and catches any statement or visual description “which has the capacity, tendency, or effect of deceiving or misleading consumers.” Capacity to mislead is enough; nobody has to have actually been misled.
