Massachusetts’s own consumer protection law
Class actions are almost always federal or multi-state, so living in Massachusetts rarely decides whether you can claim from a settlement. Where it can matter is when the claim rests on Massachusetts’s own statute.
Massachusetts Consumer Protection Act (Chapter 93A) (M.G.L. c. 93A § 2). One sentence does the work: “Unfair methods of competition and unfair or deceptive acts or practices in the conduct of any trade or commerce are hereby declared unlawful.” The statute then tells courts to be guided by the FTC and the federal courts on section 5(a)(1) when construing it in private actions brought under sections four, nine and eleven.
Consumer-protection actions under Chapter 93A must be commenced within four years of accrual (M.G.L. c. 260 § 5A).
