New Jersey’s own consumer protection law
Class actions are almost always federal or multi-state, so living in New Jersey rarely decides whether you can claim from a settlement. Where it can matter is when the claim rests on New Jersey’s own statute.
New Jersey Consumer Fraud Act (N.J.S.A. 56:8-2). It opens with “unconscionable commercial practice” before it gets to deception, fraud and misrepresentation, and it covers “any merchandise or real estate.” Two consequences: conduct can be actionable for being grossly unfair rather than untrue, and property transactions are inside the Act rather than outside it.
