Minnesota’s own consumer protection law
Class actions are almost always federal or multi-state, so living in Minnesota rarely decides whether you can claim from a settlement. Where it can matter is when the claim rests on Minnesota’s own statute.
Minnesota Prevention of Consumer Fraud Act (Minn. Stat. § 325F.69). It reaches “any fraud, unfair or unconscionable practice, false pretense, false promise, misrepresentation, misleading statement or deceptive practice, with the intent that others rely thereon” in the sale of merchandise — and applies “whether or not any person has in fact been misled.” Intent that others rely is required; proof that they did is not.
