Texas’s own consumer protection law
Class actions are almost always federal or multi-state, so living in Texas rarely decides whether you can claim from a settlement. Where it can matter is when the claim rests on Texas’s own statute.
Texas Deceptive Trade Practices–Consumer Protection Act (Tex. Bus. & Com. Code § 17.46). “False, misleading, or deceptive acts or practices in the conduct of any trade or commerce are hereby declared unlawful,” followed by the enumerated list Texas lawyers call the laundry list — passing off goods as another’s, confusion as to source or sponsorship, and so on. The list is expressly “not limited to,” and the consumer protection division enforces it.
