Florida’s own consumer protection law
Class actions are almost always federal or multi-state, so living in Florida rarely decides whether you can claim from a settlement. Where it can matter is when the claim rests on Florida’s own statute.
Florida Deceptive and Unfair Trade Practices Act (Fla. Stat. § 501.204). It declares unlawful “unfair methods of competition, unconscionable acts or practices, and unfair or deceptive acts or practices.” The middle limb matters: Florida bans unconscionable conduct alongside deceptive conduct, so a practice can be actionable for being grossly one-sided rather than untrue. Courts must give “great weight” to FTC interpretations of section 5(a)(1) as they stood on 1 July 2017.
